Business Insurance & Property Damage: When Am I Liable?

Business insurance is something that most businesses simply must have. Business insurance, or Commercial General Liability coverage, protects businesses against unforeseen injury or property damage claims that should arise. While this coverage provides invaluable financial protection for a number of scenarios, not all instances of property damage will be covered. It is important that you thoroughly examine the terms of your policy to determine your level of coverage.

The following are typically not covered under a business’ insurance policy:

  • Punitive damages: Business insurance will not cover any punitive damages that may be imposed in the event that your business is sued. Any punitive damages must be paid out-of-pocket.
  • Intentional acts: What if your employee suddenly decides to assault one of your customers in your store? Your business insurance will not cover the resulting damages if the customer decides to sue, since this is considered an intentional act. If your employee was defending themselves or the company from a criminal act, business insurance may provide coverage.
  • Auto accidents: Accidents involving delivery trucks or any other company-owned vehicle are not covered under standard business insurance. Accidents involving commercial vehicles are only covered if your business has purchased a separate commercial auto Insurance policy.
  • Faulty workmanship: Business insurance will not cover any damages that should result from your company’s workmanship. Damage to a customer’s property as a result of clumsy craftsmanship that would ordinarily be covered by company warranty will not be reimbursed.
  • Employee injuries: Business insurance does not provide compensation for any injuries your employee may sustain on the job. In Texas, injuries to employees are handled under the state’s workers’ compensation program.
